DECATUR - The woman accused of driving under the influence of alcohol early Sunday morning in a crash that killed two of her passengers and seriously injured a third was out on bond awaiting a court hearing on an earlier DUI charge, court records show.
Eileen M. McMahon, 22, who lives in Decatur, is now being held in jail in lieu of a $1 million bond and is charged with three counts of aggravated DUI, one for each passenger. Her blood-alcohol level on Sunday was said to be 0.192 percent. The legal limit for impaired driving in Illinois is 0.08 percent.
Killed in Sunday's accident, which happened about 12:18 a.m. near the intersection of North Water Street and Kellar Lane, were Anthony Samuelson, 24, of Decatur, and Matthew Yelovich, 24, of Mount Zion. A third passenger, Lori Fenner Vegovisch, 22, also from Decatur, suffered multiple broken ribs and facial cuts and is being treated at Decatur Memorial Hospital, according to police.
Court records show it was Fenner Vegovisch who posted McMahon's $300 bond Oct. 26 in Macon County Circuit Court after McMahon had been charged with the earlier DUI and improper stopping in the roadway.
In a sworn statement describing Sunday's accident, Decatur Police officer James Tertocha said McMahon told him her car had been traveling at 50 to 60 mph when she lost control and it careened into a house. Tertocha said the two men were seated in the back and were pronounced dead at the scene.
The officer later arrested McMahon at Decatur Memorial Hospital where he described her as having watery, bloodshot eyes and a strong smell of alcohol on her breath. After being read her rights, Tertocha said McMahon told him: "She started consuming Apple Bacardi at approximately 6 p.m. Saturday and finished half a pint.
"McMahon stated she continued drinking shots while at a local bar later in the evening. McMahon stated she had three shots."
McMahon was due in court Dec. 5 to answer her first DUI charge and now has another court appearance scheduled for Nov. 24 to be arraigned on Sunday's charges.
Deputy Police Chief, James Chervinko, said Monday that police investigations into the accident were continuing.
