Three charged in drug-related shooting

DECATUR - Three Decatur men allegedly involved in a drug deal Thursday that ended in a shooting have been charged in Macon County Circuit Court with five Class X felonies and an assortment of drug charges.

Charged on Monday were Derek M. Leonard, 29; his cousin, Justin S. Powell, 26; and Shawn P. Stanley, 18, the alleged shooter. All three face two counts of attempted murder and one count each of armed robbery, aggravated battery with a firearm and armed violence. Leonard also is charged with the Class X offense of armed habitual criminal.

All three are charged with unlawful possession of between 30 and 500 grams of marijuana with intent to deliver. Powell is charged with unlawful possession of 30 to 500 grams of marijuana with a prior unlawful possession of marijuana conviction. Stanley and Powell are charged with unlawful possession of 30 to 500 grams of marijuana.

The trio is likely to appear today before a judge to be informed of the charges. They remained in jail on Monday, Stanley under $100,000 bond, Leonard under $500,000 bond and Powell under $50,000 bond.

The two counts of attempted murder carry prison terms of six to 30 years. The first count also alleges the shooting caused great bodily harm to the victim, Justin D.A. Tate, 19, of Oakley. If convicted of that charge, the suspects would receive a mandatory add-on sentence of 25 years to life beyond whatever sentence is given by a judge for attempted murder.

If the second count of attempted murder is proven, without the great bodily harm provision, the mandatory add-on sentence would be 15 years.

Stanley and Powell were arrested by Decatur police on Thursday, less than four hours after Tate was shot in the upper chest. He was treated at a local hospital for his wound, which police said was not life threatening, and was in serious but stable condition.

During an interview, Powell stated he arranged for the purchase of 8 ounces of marijuana between Leonard and a 16-year-old male for $620, Decatur police officer Bryan C. Kaylor said in a sworn statement. Powell stated Stanley went inside a house in the 500 block of West Garfield Avenue to complete the transaction.

During his interview, Stanley stated he received a .380 caliber pistol from Leonard which he used to rob the supplier of the marijuana, Kaylor said. As he left the house, Stanley stated he fired one shot at a man (Tate) who he believed was possibly armed and chasing him, Kaylor said.
