Driver faces six felony charges in fatal DUI accident

DECATUR - Eileen M. McMahon, 22, was charged Wednesday in Macon County Circuit Court with six felonies in connection with being the driver of a car that crashed early Sunday, resulting in the deaths of two of her three passengers.

McMahon, who has been jailed under $1 million bond, appeared Wednesday before Associate Judge James Coryell and requested time to hire an attorney. Coryell scheduled an appearance of counsel for Dec. 3.

Police reports indicate McMahon was northbound on Water Street at Keller Lane when she lost control of her car and struck a brick house.

Her two backseat passengers, Anthony Samuelson, 24, of Decatur and Matthew Yelovich, 24, of Mount Zion, were ejected through the car's windows and killed instantly, one by an impact with a bus stop pylon and the other by hitting the house. Neither man was wearing a seatbelt.

The Decatur Police Department's Fatal Accident Investigation Team established McMahon's car was going between 53 and 60 mph at the time she lost control.

The charges filed against McMahon were aggravated driving under the influence of alcohol resulting in the deaths of two persons, aggravated driving with a blood alcohol concentration of 0.08 or more resulting in the deaths of two persons, two counts of reckless homicide and two counts of aggravated driving under the influence of alcohol resulting in great bodily harm.

The last two charges relate to McMahon's third passenger, Lori Fenner-Vegovisch, 22, who suffered severe injuries in the wreck; she initially was listed in critical condition but apparently is recovering. No information on her condition has been released since the initial accident report.

In a statement filed in court, police officer James A. Tertocha said he spoke with McMahon early Sunday at Decatur Memorial Hospital, where she had been taken for treatment of injuries. He said medical blood was drawn and showed a blood alcohol content of 0.192 percent.

That level is more than twice the legal intoxication level set by state law of 0.08 percent.

McMahon stated she started drinking rum about 6 p.m. Saturday and consumed a half pint before going to a tavern where she had three shots, Tertocha said.
