LeRoy man faces additional charges in death of sister-in-law

BLOOMINGTON - Three additional charges were filed Thursday against a LeRoy man accused of killing his pregnant sister-in-law as his wife and three children slept in the same room.

Jason Marksteiner, 21, now faces three counts of intentional homicide of an unborn child in addition to three counts of murder and two counts of aggravated criminal sexual assault.

Jodi N. McGrew, 19, of Hallsville was found Tuesday morning with Marksteiner in an upstairs bedroom of a home owned by his parents in LeRoy.

According to preliminary autopsy results, McGrew was in her second trimester of pregnancy and died of blunt-force trauma to the head with strangulation listed as a "significant contributing factor."

A statement read in court Wednesday indicates that McGrew stayed at the home Monday night so she could baby-sit the Marksteiners' three children Tuesday.

First Assistant State's Attorney Kim Campbell went on to say in court that Marksteiner's wife, Samantha, reported waking up and seeing her injured sister and her husband, both naked on the floor. She said she did not hear the attack but woke up when an alarm went off at 6:15 a.m.

Marksteiner may be eligible for the death penalty if convicted. Campbell said Thursday that any death penalty potential will be reviewed by State's Attorney Bill Yoder. The death penalty is possible in cases in which murder was committed during another felony, such as an aggravated sexual assault, and that murder involved a calculated, premeditated plan.

The state has 120 days to make the death penalty decision.

Marksteiner remains jailed in lieu of posting $100,000.

The accusations against Marksteiner follow several past disputes with his wife and members of her family.

In August, he was accused of criminal damage to property and disorderly conduct after police said he damaged his mother-in-law's vehicle. He received 12 months of court supervision and was ordered to undergo drug and alcohol treatment.

In August 2007, Samantha Marksteiner filed two petitions for order of protections against her husband. Both were dismissed when she failed to appear in court, according to DeWitt County court records.

Marksteiner is due in court Nov. 14 for an arraignment.
